CityApp™ Privacy Policy

This Privacy Policy () governs the manner in which DMKware Inc. ( or ) collects, uses, discloses, and safeguards personal information in connection with the use of its proprietary digital services, including the CityApp online platform and mobile application (collectively, the ).

By accessing or using the Platform, you ( or ) consent to the data practices described in this Policy. If you do not agree with any terms herein, you must refrain from using the Platform. 

1. Legal Framework

DMKware is committed to compliance with applicable privacy legislation, including, but not limited to:

  • The Personal Information Protection and Electronic Documents Act (PIPEDA), S.C. 2000, c. 5;

  • Applicable provincial legislation where not federally preempted;

  • The Canadian Anti-Spam Legislation (CASL), S.C. 2010, c. 23;

  • Relevant common law principles governing privacy, data protection, and fiduciary duties arising in a commercial context.

2. Definition of Personal Information

For purposes of this Policy, means information about an identifiable individual, as defined in section 2(1) of PIPEDA, including, but not limited to:

  • Full name;

  • Contact information (email address, telephone number, mailing address);

  • Location data;

  • IP address and device identifiers;

  • User-generated content, communications, and usage patterns where such data is linked to an individual.

3. Collection of Personal Information

3.1. Information You Provide Directly. We collect Personal Information that you voluntarily provide when:

  • Creating or updating an account;

  • Submitting content, messages, or feedback;

  • Making inquiries or contacting customer support;

  • Participating in surveys, promotions, or beta testing.

3.2. Information Collected Automatically. We may automatically collect technical data through cookies, log files, and analytics tools, including:

  • Device and browser type;

  • Operating system;

  • Referring URLs;

  • Usage and interaction data within the Platform.

3.3. Third-Party Sources. Where permitted by law, we may collect or supplement Personal Information using third-party services or public sources, provided such collection complies with PIPEDA and applicable contractual obligations.

4. Purpose of Collection and Use

We collect and use Personal Information strictly for purposes that are lawful, explicitly identified, and limited to what is reasonably necessary, including:

  • To create, manage, and secure user accounts;

  • To provide, maintain, and improve the Platform and Services;

  • To personalize the user experience;

  • To respond to inquiries or technical support requests;

  • To analyze usage patterns and enhance performance;

  • To comply with legal obligations and law enforcement requests;

  • To prevent fraud, abuse, and unauthorized access;

  • To communicate service updates, administrative notices, or consent-based marketing (subject to CASL compliance).

Personal Information shall not be used for purposes beyond those identified, without obtaining further consent unless authorized by law.

5. Consent

5.1. Obtaining Consent. Except where otherwise permitted or required by law, we obtain informed, voluntary, and meaningful consent before collecting, using, or disclosing Personal Information. Consent may be express or implied depending on the context and sensitivity of the information.

5.2. Withdrawing Consent. Users may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. To do so, please contact our Privacy Officer at the contact details provided below.

6. Disclosure of Personal Information

DMKware does not sell Personal Information. Disclosure to third parties is limited to:

  • Service Providers: Third-party vendors under contract to provide infrastructure, hosting, analytics, customer support, or other operational services, who are bound by obligations of confidentiality and data protection;

  • Legal and Regulatory Compliance: To government authorities or law enforcement where required to comply with a subpoena, warrant, court order, or applicable legislation;

  • Corporate Transactions: In the context of a merger, acquisition, asset sale, or corporate restructuring, provided that the receiving party agrees to uphold protections materially similar to those set out in this Policy.

7. Retention of Personal Information

Personal Information shall be retained only as long as necessary to fulfill the purposes for which it was collected, or as otherwise permitted or required by law. Upon expiration of the applicable retention period, Personal Information shall be securely destroyed, deleted, or anonymized in accordance with industry best practices.

8. Data Security Measures

DMKware employs physical, technical, and organizational safeguards designed to protect Personal Information against loss, theft, unauthorized access, disclosure, copying, use, or modification. These measures include, but are not limited to:

  • Encryption of data in transit and at rest;

  • Access controls and role-based permissions;

  • Routine security audits and vulnerability assessments;

  • Secure coding and data handling practices.

Despite our efforts, no method of transmission over the Internet or electronic storage is fully secure. Accordingly, we cannot guarantee absolute security.

9. User Rights and Access Requests

9.1. Right of Access. You have the right to request access to your Personal Information under our custody or control and to inquire about how it has been used and disclosed.

9.2. Right to Correction. You may request correction of inaccurate or incomplete Personal Information.

9.3. Request Procedure. To exercise these rights, please submit a written request to our Privacy Officer at the contact information provided in Section 13. We will respond in accordance with PIPEDA, typically within thirty (30) calendar days.

10. Cookies and Tracking Technologies 

The Platform uses cookies and similar technologies to facilitate certain functions, enhance user experience, and collect analytics data. Users may configure their browser settings to refuse or delete cookies. However, doing so may impair functionality.

11. Children's Privacy

The Platform is not directed to individuals under the age of thirteen (13) (or such greater age required in your province for you to be authorized to register for and use our services without parental approval). We do not knowingly collect Personal Information from minors.

12. Contact Information and Complaints

DMKware Inc. has appointed a Privacy Officer responsible for ensuring compliance with this Policy and applicable legislation.

14. Modifications to this Policy

We reserve the right to modify this Privacy Policy at any time. Any material changes will be communicated through the Platform or other appropriate channels. Your continued use of the Platform following the posting of changes constitutes your acceptance of such changes.
